Prohibition on GAG Clauses on Price and Quality Information in Provider Agreements
The Centers for Medicare & Medicaid Services (CMS) are now collecting Gag Clause Prohibition Compliance Attestations (GCPCA) on behalf of the Departments of the Treasury, Labor and Health and Human Services. The provisions of this prohibition generally prohibit plans and issuers from entering into an agreement with a health care provider, network or association of providers, third-party administrator (TPA) or other service provider offering access to a network of providers that would directly or indirectly restrict a plan or issuer from providing, accessing, or sharing certain information related to cost or quality of care or deidentified claims and encounter information. An annual submission of Gag Clause Prohibition Compliance Attestation is required.
SummaCare will be submitting this attestation by December 31, 2023, on behalf of all currently enrolled groups as well as former groups that terminated December 27, 2020, forward per the regulation. SummaCare will do so annually for subsequent attestations.
Tax Forms for MEWA Groups
Employers enrolled in the Chamber Health Benefits Plan (MEWA) are required to file form 1094-B with the Internal Revenue Service (IRS). Employer groups are also required to provide the 1095-B form for all employees covered anytime in 2023. For the 2023 tax year, SummaCare is preparing 1094-B (employer) and 1095-B (employees) forms for groups covered during the 2023 calendar year. A pdf packet will be posted to the employer Plan Central account by the end of January 2024.
