The Internal Revenue Service IRS issued updated instructions for preparing and submitting ACA health insurance coverage and employer reporting Forms 1094 and 1095 B and 1094 and 1095 C. In previous years, entities filing 250 or more 1095 forms were required to file electronically. Now, entities filing 10 or more of these forms will need to send them into the IRS electronically.
The expanded electronic filing requirement will apply to health insurance carriers, self-funded and level-funded plans, and applicable large employers (ALEs) when they are documenting 2023 health coverage offers and status during the upcoming employer reporting season, which will take place in the winter of 2024. Brokers with smaller group clients that are ALEs or are offering level-funded coverage and therefore need to file and distribute Forms 1094 and 1095 B or C should check to make sure that these employer group plans have an electronic filing solution in place for the year ahead.
